Idaho’s Theocratic Lawmakers Dismiss TST’s Abortion Lawsuit

The legal battle for bodily autonomy and the sacred principle of church-state separation has once again been struck down by theocratic lawmakers. Chief U.S. District Judge David Nye permanently dismissed the Satanic Temple’s (TST) challenge to Idaho’s draconian abortion laws. This decision, which the Idaho Attorney General hailed as a victory for “Idaho’s values,” is proof that Idaho lawmakers care more about Christian values than the rule of the law.

The Satanic Temple, which focuses on an allegorical Satan as a symbol of rebellion against arbitrary authority and a defender of personal sovereignty, brought its challenge on the grounds that Idaho’s near-total abortion ban violated the religious freedom of its members. TST’s argument was clear and compelling. That these restrictions infringes upon the religious right of bodily autonomy, a central tenet of their faith. They argued that the state’s actions amounted to a “taking” of a pregnant person’s economic value and even constituted involuntary servitude under the Thirteenth Amendment.

However, Judge Nye refused to engage with the substance of these claims, and dismissed the case with prejudice. Nye dismissed the case on the technicality of “lack of standing,” asserting that TST could not identify members who had been sufficiently harmed. In a display of judicial contempt that betrays a clear bias, Nye went further, describing TST’s arguments as “absurd” and “outlandish”. He concluded that TST’s efforts to fit its constitutional disagreements with the law were like “trying to fit a square peg in a round hole,” a phrase that perfectly encapsulates the judiciary’s unwillingness to apply secular legal principles when they clash with the state’s preferred religious morality.

The judge’s language, and the rhetoric of Idaho Attorney General Raúl Labrador, reveal the true nature of the conflict. Labrador, in his celebration of the ruling, explicitly framed the state’s position in moral and religious terms, stating that the decision “confirms those protections are constitutionally sound” and that the state will “continue protecting the right of Idaho’s elected representatives to defend life“. The term “pro-life” itself is a political euphemism for a religiously-motivated mandate, a clear indication that the state is legislating not from a position of secular governance, but from a foundation of Christian morality.

As TST co-founder Lucien Greaves noted, the dismissal was a “cowardly punt” that refused to examine the legal merits of the claim. Obviously, it is a system that will bend over backward to protect the religious freedom of the majority, but will summarily dismiss the claims of a minority faith when those claims threaten the established order.

The Satanic Temple remains undeterred, planning to refile the claim when they have a member that is pregnant, a move that will force the courts to finally address the merits of the case. Until then, this ruling stands as a stark example of the failure of the separation of church and state in Idaho. The fight for true religious pluralism and bodily autonomy continues.
